Law court rape

An 11-year old marriage between Modinat and Musa Adekunbi has been dissolved by an Orile-Agege Customary Court in Lagos State on the grounds of adultery and threat to life.

According to reports, President of the court, Adegboyega Omilola, dissolved the marriage after hearing the claims of Modinat and Musa.

It was gathered that 35-year old Modinat had pleaded with the court on December 12, 2013, seeking the dissolution of her marriage to Musa, alleging adultery and threat to her life.

Nigerian Tribune reports:

Modinat,  a nurse, who lives at 1, Musa Adekunbi Close, off Aderogba Street, Isefun, Ayobo, Lagos State, had told the court that her husband packed out of the house in August 2013.

“I came home on  this particular day and found out that my husband had packed all his belongings and left  home.

“I was disturbed and went to my husband’s family. It was there I was told that he  had built another house and moved  in with his new wife.

“I nearly fainted because I trusted and loved him. I didn’t know what would have prompted his behaviour after we already  had three children.

“All efforts to talk to my husband proved abortive and he and his wife threatened me through text messages,” she said.

The mother of three told the court that her husband left the kids with her and put the responsibilities of their  upkeep and training on her.

“I want the court to dissolve the union, grant me custody of  our children and ask him to take over their responsibilities,’’ she said.

Forty-three-year-old Musa, an  accountant  who lives at 1, Ifekoya Street, Dopemu, Agege,  Lagos State, denied the allegations.

“I packed out of the house to be free from her troubles. My house was robbed thrice and it was in the process of investigation that I found out that my wife’s sister  was involved.

“My wife is fetish; whenever she visits her family, she comes back with  many incisions on her body.

“I can’t continue to  live with her, so I packed out; I don’t love her anymore, I support the dissolution,’’ he said.

In his ruling, the court president said the marriage had broken down irretrievably.

“Starting from today, you cease to be addressed as husband and wife. You shall go your separate ways and maintain the peace.

“The custody of the children is referred to Ikeja Family Court for final decision.

“In the interim, the children should remain with their mother, and their father should be responsible for their educational and medical bills,’’ Omilola said.
