Oil company rejects subsidy report, sues government

An oil company, Integrated Oil and Gas Limited got a temporary reprieve from a Federal High Court yesterday barring it from prosecution on the alleged wrongful claim of N13.2 billion fuel subsidy funds.

The company, owned by a former Internal Affairs Minister, Capt. Emmanuel Ihenacho (rtd.), sued the House of Representatives, Farouk Lawan, AGF, EFCC, ICPC and the Inspector General of Police who were all joined as respondents in the suit.

The Company requested an injunction restraining the defendants from taking steps against the plaintiff on account of the subsidy report. It based its argument on the resolution of the first defendant passed on April 25, which labeled the report of the Ad-hoc Committee as illegal.

Justice Gladys Olotu who gave the ruling ordered all parties to stay action pending the determination of the originating summons filed by the oil company.

“The government and its agents are hereby prevented from arresting, detaining, prosecuting and recovering the N13.2 billion alleged to have been received by the plaintiff as fuel subsidy claims, pending the determination of the case,” she said.

The Attorney General of the Federation, Mohammed Adoke Bello, who is the third defendant in the suit has, however, stated that the fuel marketers indicted in the House of Representatives Ad-hoc fuel subsidy report will not be prosecuted.

He made this submission in a sworn affidavit deposed to at a Federal High Court in Abuja.

The case was adjourned to October 18 for hearing.
